These Terms of Use ("Terms") govern your use of https://leather-boots.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is, and what it is not

The Site publishes general information about leather boot care, fit, materials, construction, and styles. We are not a retailer, a brand, a boot maker, or a cobbler. We do not sell boots, care products, or any other product.

General information only

Content on the Site is for general information. It is not professional, safety, or medical advice. Prices, sizes, materials, features, and availability are set by retailers and makers, and they can change. Makers may change a product at any time, so a boot or care product may not match an older description. Check the maker's information and the retailer's listing before you buy.

Leather care products

Leathers and finishes differ. Cleaners, conditioners, oils, creams, polishes, and protector sprays can darken, stain, or otherwise change leather, suede, and nubuck. Follow the boot maker's care instructions and the directions on any care product, and test a product on a hidden spot first. Care steps on the Site that come from a boot maker are that maker's guidance, credited to it; we have not tested them. We are not responsible for damage to boots or other items from following general information on the Site.

Leather labels and maker claims

Label terms such as "leather", "genuine leather", "full grain", "top grain", "waterproof", and "water resistant" are the maker's descriptions, not ours. Where the Site summarizes the FTC Guides for Select Leather and Imitation Leather Products (16 CFR Part 24), it is a plain summary for general information, not legal advice, and the official text controls. We do not verify any maker's claims about materials, construction, water resistance, durability, or resoling.

Fit, comfort, and work use

Sizes, widths, and fit differ between makers. Information about fit and breaking in is general. Footwear that causes pain, numbness, or a foot problem should not be worn through; ask a qualified professional, such as a doctor or podiatrist, about foot pain or a foot condition. The Site does not cover safety or protective footwear, and nothing on it means a boot is suitable for work, hazards, or any safety standard. Check the maker's ratings for any work use.

Brand names and trademarks

Brand and product names mentioned on the Site belong to their owners. We use them only to identify products. The Site is not affiliated with, sponsored by, or endorsed by any brand it mentions, and a mention does not mean two products are the same or equivalent.

Some links may be affiliate links. We may earn a commission if you buy through them, at no extra cost to you. Any purchase is between you and the retailer, under the retailer's terms. See our Affiliate Disclosure.

Eligibility

The Site is for a general audience. It is not directed to children under 13.

Acceptable use

You agree not to:

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PURCHASE FROM A THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
